Abstract: Since 2021, major technology companies have begun to plan the metaverse. According to different construction technologies, digital human in the metaverse can be divided into realistic digital human under virtual augmented technology and human-made digital human under artificial intelligence technology. The latter can be subdivided into automatic digital human and autonomous digital human. Different types of digital human have different legal status. Realistic digital human is the mapping of a natural person in the metaverse. The corresponding person in reality should assume the rights and obligations, and it is necessary to establish the access system for it. Automatic digital human is controlled by algorithms and procedures, so it should be identified as a legal object. Its producers, designers and users should bear corresponding responsibilities for the damage caused by its behavior. A supervisory system can be established to manage and supervise it. Autonomous digital human has been able to express its intentions independently from the control of its producers, designers and users. It should be given the legal subject status to make it enjoy personality rights and property rights, and assume the obligation of amity.
