Abstract: For reason of history, the protection of right of intelligence property in China is comparably indifferent. And the complete legal system has not formed at present. The swift and violent development of computer information network technique makes the right of intelligence property in network space face serious challenge. However in the digital age of “information is power”, the protection to right of intelligence property in network is also a threat to protection to the continuous development of network, knowledge and intelligence. This is a paradox. The article gives a particular opinion on the paradox.
