Abstract: In the legal norms and judicial practices, there are many contradictions and differences about the affirmation of the accidental responsibility in the fire that can be sued. In orderto clarify the essence of this question, we only recognize its basic attribute from the nature of the affirmation of the accidental responsibility in the fire, and grasp the effect of the legal provisions about the affirmation of the accidental responsibility in the fire from the angle of legal principles, then we will make clear that the affirmation of the accidental responsibility in the fire is a kind of concrete administrative behavior that can be sued. The author expects that those improper legal provisions can be abolished as soon as possible and a consensus can be reached on the affirmation of the accidental responsibility in the fire that can be sued, so that the socialist construction governed by the law can be advanced and the fundamental interests of the people can be safeguarded.
