Abstract: Limited to the executive compensation system by the existing State Compensation Law established ,academics and lawyers do not distinguish between environment executive compensation and environmental tort executive compensation, Only concerned about compensation for environmental administrative organs and their staff illegal use of their authority and the damage caused. Reality, in addition to environmental executive, other administrative organs and the state-owned public facilities may also damage through the environment media to the personal, property and other legitimate rights and interests. As the basis for causing such harm is a legal relationship between administrative law, and so there may be executive compensation. In the process of perfection of law of the People`s Republic of China on State Compensation ,we should be to respond.
