Abstract:

The P2P technology not only increases the efficiency of information transmission and change people’s way of life, but also causes severe copyright infringement issues To accuse software and Internet service providers of the secondary infringement is more effective than accuse terminal users of primary infringement The Chinese copyright law has not introduced the doctrine of secondary liability, so it is very necessary to borrow the doctrine of secondary infringement relating to P2P from America and Australia, which have already formed mature theory of secondary infringement, construct the indirect copyright infringement confirmative rules, and at the same time, balance the relationship between copyright protection and the development P2P technology
