摘要：

以《北美自由贸易协定》（NAFTA）中投资专章的环保规则为研究对象，并结合两个典型的案例，运用案例分析的方法，探究目前世界上处理国际投资与环境保护的冲突的做法。经研究表明，虽然NAFTA采取了在投资专章纳入环保规则的一种新的立法模式，试图去协调投资利益和环保利益，但实践中NAFTA未能较好地处理投资与环保的冲突，仲裁员屡屡牺牲了东道国的环保目标。最后仔细分析了出现此种研究结果的原因，根据研究结果对我国提出了相关建议，以便我国在签订对外投资协定时能吸取NAFTA的经验教训，较好地处理投资与国内环保的冲突。

Abstract:

Based on the environmental rules in Chapter 11 of North American Free Trade Agreement (NAFTA) and combined with two typical cases, the way to settle down the conflict between international investment and environmental protection worldwide in recent times is explored The results show that the signing of NAFTA is deemed as a landmark in environmental protection, which tries to balance the conflict between international investment and environmental protection, however in practice, NAFTA fails to coordinate this conflict effectively, and the aim of environmental protection of a host country also fails to achieve Finally, the reason why this happened is analyzed? According to the results, advice to our government when it signs the foreign investment agreement with other countries in the future is given, so that China can learn some experience from NAFTA when dealing with the conflict between the investment and domestic environmental protection
