Abstract:

Based on the environmental rules in Chapter 11 of North American Free Trade Agreement (NAFTA) and combined with two typical cases, the way to settle down the conflict between international investment and environmental protection worldwide in recent times is explored The results show that the signing of NAFTA is deemed as a landmark in environmental protection, which tries to balance the conflict between international investment and environmental protection, however in practice, NAFTA fails to coordinate this conflict effectively, and the aim of environmental protection of a host country also fails to achieve Finally, the reason why this happened is analyzed? According to the results, advice to our government when it signs the foreign investment agreement with other countries in the future is given, so that China can learn some experience from NAFTA when dealing with the conflict between the investment and domestic environmental protection
