Realistic Restriction of Online Public Opinions’ Participation in Judicial Adjudication #br# from the Perspective of Procedural Justice

Abstract:

 Online public opinions’ participation in judicial adjudication is important to promote public participation in justice The procedural justice is the foundation of fairness and authority of justice and the bottom line which any subjects’ participation in justice must respect, and it becomes the basic limit and restriction of online public opinions’ participation in judicial adjudication Procedural justice, procedural rationality and dual process mechanism which ensure the orderly and effective participation are not only the filtering mechanism to the irrational factors of online public opinions, but also the balance mechanism to the substantive justice tendency and substantial reasoning approach
