Administrative Regulations on Copyright Infringement by Web Crawlers

Abstract: Web crawler is an emerging Internet technology used to automatically search and crawl the specified network information according to the order, but there is a risk of being abused. Web crawler is a tool of crawling network copyright data information, and copyright infringement by web crawling behaviors happens frequently. At present, regulations for copyright infringement by web crawling behaviors are always found in civil laws and criminal laws, while administrative regulations are ignored. Current administrative regulations for copyright infringement by web crawling behaviors have problems that they rely too much on judicial means, and lack norms and online supervision made by administrative organizations. All these hinder the application and development of administrative regulations for copyright infringement by web crawling behaviors. In this regard, administrative means should be used to restrain copyright infringement by web crawling behaviors and protect the legal interests of copyright owners through building a full-coverage warning system, improving the copyright management, and setting up self-regulatory obligations for web crawler users, etc.
