网络时代律师庭外言论的规制

摘要/Abstract

摘要：

律师庭外言论是律师在法庭之外就其代理或辩护的案件所公开发表的言论。现代网络信息技术的发展为律师庭外言论的扩张提供了条件，在胜诉利益的驱使下，律师的庭外言论迅速兴起。当前我国对律师庭外言论的规制存在规范粗疏、合法性不足以及过度规制等问题。对律师庭外言论的规制需要把握两个前提，一是准确厘定律师庭外言论规制的对象；二是全面衡量律师庭外言论的价值。在律师庭外言论的规制中应贯彻平衡性、合理性与合法性的原则。

Abstract:

The lawyers’ extrajudicial statements are the statements that are openly said by the lawyers on an agency or on defense The modern Internet technologies provide preference for the expansion of lawyers’ extrajudicial statements The lawyers’ extrajudicial statements develop rapidly under the driving force of winning a lawsuit There are many defects on the regulation of the lawyers’ extrajudicial statements, including deficient norms, inadequate legality and excessive restrictions Two prerequisites should be concerned for the regulations of the lawyers’ extrajudicial statements The first one is the accurate definition of the regulation subjects and the second one is the comprehensive assurance of the value of the lawyers’ extrajudicial statements The balanced, reasonable and legitimate principles should be implemented in the whole procedure of the regulation of the lawyers’ extrajudicial statements
