Abstract: ：The content of the proof standard in civil action is objective；however，its process of realization is subjective．Existing civil legislation about the proof standard in china is still based on objective reality and has obvious shortages．The reform direction of proof standard in civil action should aim at the high degree probability which is based on legal reality, but should follow the operation rule of modern civil action．
