Abstract:

Single copyright protection has been unable to meet the needs of the development of cultural and creative industry in China, so the compound and cooperative intellectual property protection system should be set up The three dimensional nature of “culture”, “creativity”, “industry” of cultural and creative industry, and the characteristics of invisible object, species diversity, and functional complementation of the intellectual property, jointly determine content architecture of the intellectual property strategy of cultural and creative industry The construction of intellectual property protection strategy of cultural and creative industry should take copyright as the core, and the patent rights, trademark, trade secret right and anti-unfair competition strategy as the auxiliary factors How to effectively obtain and protect the different forms of intellectual property to promote the development of cultural and creative industry is a central problem in the construction of intellectual property protection strategy The government, industry associations and creative enterprises should play their respective roles in order to jointly promote the construction and effective operation of the intellectual property protection strategy
