迈向可信的法律算法化

Towards Credible Algorithmization of Law

摘要: 法律算法化虽然与可信人工智能概念密切联系,却无法实现算法的可信性,需要与数字人权相结合,共同解决算法信任问题。现有批判没有认识到法律算法化的合理性与法律追求安定性的内在品质,仅从法律价值的视角质疑法律算法化的理论意义,这种批判是无力的。法律算法化认识到仅凭外部监管无法降低算法风险,试图通过将法律融入算法的方式控制算法活动,实现算法的可信性。然而,法律算法化误认为算法信任困境只源于算法技术风险,忽视算法信任困境的产生和认识不透明与算法社会中利益风险分配失衡密切关联。算法的非物质性亦加深算法信任危机。在算法信任差距尚未被完全弥合的语境下,法律算法化应保持足够克制,较多发展法律风险预防技术,较少干涉权利义务分配问题。在数字人权的配合下,可以将法律算法化作为发展算法合作治理模式的契机,并在算法合作治理中优化法律算法化。

Abstract: Although legal algorithmization is closely related to the concept of trustworthy artificial intelligence (AI), it cannot achieve the credibility of algorithms, and it needs to be combined with digital human rights to jointly solve the problem of algorithmic trust. The existing criticism does not recognize the rationality of legal algorithmization and the inherent quality of law’s pursuit of stability, but only questions the theoretical significance of legal algorithmization from the perspective of legal value. Legal algorithmization realizes that external supervision alone cannot reduce the risk of algorithms, and attempts to control algorithm activities by integrating the law into algorithms to achieve the credibility of algorithms. However, legal algorithmization mistakenly believes that algorithmic trust dilemma only stems from the technical risks of algorithms, and ignores that the emergence of algorithmic trust dilemma is closely related to opacity and imbalance of benefit risk distribution. The immateriality of algorithms also deepens the trust crisis of algorithms. From the perspective of overcoming the trust crisis in algorithms, legal algorithmization should keep enough restraint, develop more legal risk prevention technologies, and less interfere in the distribution of rights and obligations. With the cooperation of digital human rights, legal algorithmization can be turned into an opportunity to develop the cooperative governance model of algorithms, in which legal algorithmization should be optimized.
