Abstract: The“Miscellaneous Organization”is playing an increasingly important role in the economic life nowadays,
but its legal status has not been clear in our lawsystem nor has been recognized as a civil body yet•By analyzing the
present legislation, theory and practice of the legal status of the“Miscellaneous Organization”in our country and on
the basis of comparingthemwith foreign conditions, the author suggests thatthe law-maker should grantthe status of
a civil bodyto the“MiscellaneousOrganization”and establish an open systemof the civil main body in our future civil
code•
