摘要/Abstract

摘要： 我国互联网发展进入了全新阶段，域名成为网络经营活动的一种重要商业符号。然而，我国2001年《最高人民法院关于审理涉及计算机网络域名民事纠纷案件适用法律若干问题的解释》对判定域名持有人对域名的注册与使用是否构成恶意的认定标准存在不足，应在认定时统一考虑域名持有人的主观状态，并增加对两项恶意的具体情形的考量。

Abstract: The development of the Internet has come to a new phase in China Domain name becomes an important mark in business However, the judicial interpretation on cyber-squatter has several deficiencies, especially in the identification standard on whether a person registers and uses the domain name with malice It should consider the subjective state of the person, and add two more circumstances to the standard in determining whether the person has malice
