Legal Regulation of Mechanism of Cyber-human Embodied Game Addiction

Abstract: After National Press and Publication Administration began to supervise online games, although the department implemented the first administrative punishment for violating the anti-addiction management regulation in 2021, the gap of online games supervision has not been completely filled. From the perspective of the impact of games on survival, entertainment and capital, cyber-human and their cyber behaviors have been completely digitized, and cyber-human’s body and mind have completely left the digital game, only becoming a symbol of capital value added. Although the “Internet Information Service Algorithm Recommendations Management Regulations” has defined “inducing users to indulge in games and over-consume” to a certain extent, the effect of regulation is not obvious. The regulations also face the argument of cyber-human’s free will to choose indulgence, and the difficulty in balancing the huge social value with personal value of online games. The overall regulation has become a trend, so it is advisable to establish a standard for Internet addiction disorder based on the laws, in order to lay a foundation for declaring tort liability for online addiction, and to actively establish a public interest litigation mechanism, improve algorithm administrative ability and detail the supervision models for algorithm.
