Abstract:

The civil liability which a certification authority (CA) shoulders affects the development of CA directly Electronic Signature Law of The People’s Republic of China only prescribes the principles of the civil liability of CA in an extremely simple way, which is not suitable for the rapid development of the e-commerce activities “Recommended Reliance Limit” of the United States prescribes that CA should shoulder the civil limited liability, which can promote the development of CA The provision that CA should shoulder the civil limited liability is rational and scientific, so in order to make up for the shortage of Electronic Signature Law of The People’s Republic of China, through referring the law of the United States, the article gives suggestions on the improvement of the law to ensure the healthy developing trend of CA of our country
