Legal Nature of Online Game Screen#br# ——Based on Analysis of Yaoyu Inc. vs Douyu Inc. Case

Abstract:

In recent years, how to protect copyright on network environment causes people’s attention. In 2015,
the case that Yaoyu sued Douyu on copyright infringement and unfair competition has aroused people to investigate
the legal nature of online game screen. The court finally affirmed Douyu’s acts of unfair competition, but did
not admit the online game screen as works. However, the court’s reason was not convincing. After exploring the
nature of works, and comparing it with online game screen, it is found that dispute the particularity of online
game screen, it still meets the requirements of the works. By further analyzing the factors of online game screen,
it is concluded that the online game screen belongs to copyright owners of the network games rather than the live
party or any game player. At the same time, law deficiency in protecting online game screen should be paid much
attention in academic circle.
